Those are SCAMS!!!! Don't do it! Starve first, before getting into the clutches of one of those outfits.
They may be licenced businesses, but their practices push at the edge of legality.
The service fees are usurious. Payday loans are a trap, and once you get into their clutches its difficult to get out.

My sister-in-law has about 4 payday advance loans that she's not paying. I've told her that she could go to jail for this. SHe says no she cant because its a loan,not a bad check. Does anyone know?
Normally when taking out a payday loan you have to write post-dated checks which they then will cash once the agreed upon day arrives. If there isn't money to cover the checks when they attempt to cash them, then they will file hot check charges against her and she can go to jail especially if she knew the money wasn't going to be available since that's theft by deception.

She wont got to jail, but it will get sent to collections. They can sue her and get a judgment....her wages and/or bank account can be garnished.

Well, technically it IS a bad check. When the payday loan places try to cash her check and find that it has insufficient funds, the normal course of action will take place. They will most likely try to contact her, tack on insufficient funds charges (as will her bank too!).
It's sometimes hard to prove, but if the law can show that she wrote the checks and knew that the funds were not there, yes, she could go to jail. I think it's considered fraud.

How did she get 4 payday loans without paying the prior ones? She went to 4 different places? She can go to jail since when the loan place deposits her post-dated check, it will bounce, and since paydayloans are usually several hundred dollars, and she has 4 of them, she will go to jail. It will turn into a quite lengthy, expensive battle in which the payday advance business will win. Your SIL will have to pay not only the money she owes them but any legal fees incurred. Not to mention bank fees for NSF, and the payday place's returned check fees. She may as well just suck it up and pay what she owes or it's going to cost her more in the long run than what she initially owes. If she owns a home, they can place a judgment against it that will need to be paid before she can sell or refinance it. They can also garnish her wages. She needs to just pay up before she gets into serious legal trouble.

I do not think she will go to jail. The company can sue her. They can put a claim on her if she ever works or get s TAXES they can intercept her money. They can report her to the credit agencies that would limit her ability to get any kind of loan, and damage her credit. But no , She cannot go to jail. Unless she used someone elses name or a fake account, just not paying is not grounds for incarceration.

well, if they do not have a State Id Number or an Employment Verification Number, they are not exactly a legitimate business, my boyfriend stopped paying on his two years
ago and he told them that the calls are being recorded,

Got into an unexpected financial bind and had to resort to a payday advance. Now it's like we can't escape it! Please give some advice on how to pay these people back and not have to reborrow again to cover current expenses. We make $85,000 between the both of us. This shouldn't be happening!

While it may seem simplistic, this is the correct financial advice: When you find yourself in a hole, the first order of business is to STOP DIGGING!
The only way out is to strictly budget your money until you have expenditures to the bare minimum. (that includes expensive coffees or eating out). If you have to eat baloney sandwiches for dinner for a while then that is what you do.
If there still isn't enough to cover expenses then a second part time job is in order. Around this time of year many retailers are seeking temporary help. This has the added bonus of not only increasing your income but preventing you from spending more.

On 85 K a year , you are right this shouldnt be happening. it sounds like you might be living well beyond your means. why dont you get Dave Ramseys financial peace unvieristy, no offense but it sounds like you need it.

i want you to call credit counseling in your area and see what they say i had to lessen the amount by 50.00 everytime i borrowed and it took some time but it worked and you have to cut corners and eventually it this does work been there and done that

Reduce your bills as much as possible. Even to a painful degree. What are you paying for that you can live without? Most everyone have stuff that falls into this category. Cable, internet, cell phone, phone extras, club memberships, eating out, entertainment extras, and the list goes on and on. Figure out everything that you spent money on last month. Ask yourself, is there some way that I can eliminate this or reduce it. If so then do it. Every dime that you can squeeze together you put towards paying off the payday loan debt. You may have to really cut back to do this. You may have a month or two that are kind of boring. However, get thru it and pay off the debt and then you can start to bring the extras back into your life. You have to get this payday loan squashed as soon as possible or else it will grow big and nasty.
One note, when cancelling services, make sure that you are not locked in a service contract that has a penalty for early cancelation. In those events, contact the company and see if you can suspend the service for a period of time. Sometimes, they are willing to do that.

I hate those places!!!! I got into the never ending cycle many years ago and while I wont tell you to do what I did (said screw em basically) this is my advice. Next week when you have to pay it back, just pay it. Thats it. Boom! DO NOT RENEW THE LOAN!! Go with out for a week. Trust me it will be a mother but it will work.

You will have to cut your current expenses to a minimum and use your income to pay them back. Consider selling some items, getting a part-time job, borrowing from family to get out of this hole.
Before buying anything ask yourselves - is this absolutely necessary right now? If not, don't buy it. Don't buy expensive presents for Christmas.
Buy less expensive food - cook from scratch rather than buying pre-prepared stuff. (It's better for you anyhow). Don't buy booze or luxuries. Cut down on driving. Don't go out.
Just the bare essentials until it is paid off and never use this payday advance again. I know that this sounds like no fun at all, but you were living beyond your means and now must face the consequences.
If this doesn't work for you there may be some agencies in your area that help people get out of debt - there are in Toronto. Check them out.

Follow these steps
1) write a budget
2) follow the budget
3) cut out stuff you don't need from the budget.
Write down the amount the two of you make together in a month, label it income.
Write down essential bills in one column call it needs
The NEEDS column will include only the following
Mortgage, utilities, insurance, food, gas make sure you
have savings listed as a bill here, start with $5 if you can't afford anymore.
Write down stuff that is able to be paid off in another column
The FINITE BILLS column will include the following
auto loans, payday loans, student loans, anything else that can be paid off.
Write down stuff that can't be paid off that are not necessarily needs as INFINITE BILLS this column will include the following
Cell phone bills, cable bills, high speed internet bills etc.
list the minimum payments by all of your bills and sort all of the bill columns from lowest amount to highest.
add all of the minimum payments together and subtract from your income. You will now see how much money you can play with each month. Take half of that money and put it towards the lowest dollar amount in the FINITE BILLS column. Look at the infinite bills column is there stuff there that you could live without (at least until your bills are paid off?) do you need a home phone and cell phone? do you need that extra cable package? do you need to be eating out so much? can you reduce the amount of trips you take in a week?
Your goals for now are the following
1) Make savings goals and stick with them
2) Pay off FINITE BILLS as quickly as possible
3) Look for ways to reduce NEEDS
4) Look for ways to reduce or remove INFINITE BILLS

Its worse than "not a good idea". It could ruin your finances for a very long time. Please do not take out a payday advance. I have not heard of anyone who ever took out a payday advance saying that they were happy with their decision. There are always more options. Have you tried talking to your creditors? A payday advance should be the last alternative, and should be used to make sure you don't go to jail. Otherwise, it is a bad decision.

Sorry to hear you have a cash flow problem.
If you lived in England my advice would be to ignore these sharp practice merchants with their very high interest rates but to go to a Pawn Broker and pledge say a television set ' jewelry etc say till the end of the month for say £350.
Then at the end of the month your goods are retrieved from the Pawn Broker for £350 plus a fixed fee of 10% ie an extra £35 giving £385 in total.
This method will always cost less than going down the Pay Day Advance Clowns route.

I know that it will go to collections. But what happens after that. Will they actually take me to court for $500? Their attorney cost more than that. Will it ever actually become a criminal charge?

Have you tried calling them or visiting them? Sometimes they will give a extension if you have a good reason. I don't think you should try "not" paying it. They will just cash your check. Some banks, like mine, might even just pay it and then place your account in the neg. Then they get to add fees for everything so you can never pay that amount off. Good Luck!

To begin, usually they make you fill out some type of credit application that contains your employment information. If you still are employed, or if they can find out where you are employed, they will more than likely take you to court. Which you will have to pay for their court costs. After they get a judgment in court, they can fill out some paperwork and attach your wages. And trust me your employer will garnish your wages or they are legally responsible to pay the judgment amount!
Note: Call the company and make arrangements to pay, it will cost you less money and will not hinder your credit as bad as a judgment or a collection!

no name---had the right answer...nothing, I have about 20 of them that were never paid, not by choice but I'm still experiencing hardship and it's been like 3,4 ,5 years. I hear that those places are boarderline illegal because you are not supposed to give anyone a post dated check, so on there part it was never acceptable, and I also hear that their interest rate is past legal limits for them to file lawsuit against you. I wouldn't worry and pay what you can.

Some pay day lenders have been known to cash the check, and then threaten to send you to jail for writing a bad check if it bounces.

Pretty much the same thing that would happen if you don't pay your credit card bills. They can threaten to file criminal charges against you, but that is hardly ever possible. The reason for this is that most states take the stance that if a post dated check bounces it is due to other circumstances and not fraud.

I don't want to sound mean, but here is the way it is: Not only can you not pay back a loan they took your word on, you tried to stiff them with a bad check. They aren't your mom. Get the money from someone, pay them off, and don't borrow that way again. They will have collection come after you and put this on your credit report. Plus, your bank will try to collect the insufficient funds fees from you as will the payday advance place. Not a good scene.

First off, you took out a payday loan...meaning exactly that, you owe it on your payday...Not paying it, the payday loan company will either cash your to get your money before you do, or sue you in court, get a judgement against you which will reflect on your credit report, and will be taken out of your paycheck making you pay them back anyways. Borrow the money and pay it back!
